    1. Introduction and Acceptance

    Welcome to Island Career Academy. These Terms of Service ("Terms") govern your use of our website, enrollment in our programs, and use of our services. By accessing our website or enrolling in our programs, you agree to be bound by these Terms and our Privacy Policy.

    Island Career Academy is a registered Private Career College operating under the authority of the Nova Scotia Private Career Colleges Act and regulations. Our registration demonstrates compliance with provincial standards for career training institutions.

    2. Website Use

    You agree to use our website only for lawful purposes and in accordance with these Terms. You must not:

    • Use the website in any way that violates applicable laws or regulations
    • Attempt to gain unauthorized access to our systems or data
    • Transmit any viruses, malware, or harmful code
    • Interfere with or disrupt the website or servers
    • Use automated systems to access the website without permission
    • Misrepresent your identity or affiliation

    3. Program Enrollment and Student Agreements

    Enrollment in Island Career Academy programs requires completion of an enrollment agreement that includes:

    • Program details including duration, schedule, and delivery method
    • Total tuition and fee breakdown
    • Payment schedule and methods
    • Tuition refund policy
    • Program requirements and completion criteria
    • Attendance requirements
    • Code of conduct and student responsibilities

    Enrollment is subject to meeting admission requirements and space availability. We reserve the right to refuse admission or cancel programs with insufficient enrollment.

    4. Tuition and Fees

    Payment Terms: Tuition and fees must be paid according to the schedule outlined in your enrollment agreement. We accept payment by credit card, debit card, electronic transfer, and approved student loans.

    Late Payments: Failure to make payments on time may result in suspension from classes or dismissal from the program. Students with outstanding balances will not receive certificates or transcripts until all amounts are paid in full.

    Non-Refundable Items: Registration fees and program materials provided to students are non-refundable (unless returned unopened within 5 business days).

    5. Tuition Refund Policy

    In compliance with the Private Career Colleges Operational Regulations, our refund policy is as follows:

    Before Program Start Date:

    • Students who withdraw before the program begins receive a 100% refund of tuition paid, minus the registration fee

    After Program Begins:

    Refunds are calculated based on the percentage of program hours delivered (not hours attended):

    • 0% to 10% of program completed: Refund of tuition minus proportional amount for hours delivered and registration fee
    • 10% to 30% of program completed: Prorated refund based on hours delivered, minus registration fee
    • 30% to 50% of program completed: Prorated refund based on hours delivered, minus registration fee
    • Over 50% of program completed: No refund

    Refund Calculation:

    Refunds are calculated by dividing total tuition by the total program hours, then multiplying by the number of hours delivered from the first day of class. The registration fee and cost of non-returnable materials are deducted from the refund amount.

    Refund Timeline:

    Refunds will be processed and paid within 30 days of the student's official withdrawal date. A written statement showing the refund calculation will be provided.

    Disputes:

    Any disputes regarding refund calculations must be referred to the Director of Private Career Colleges at Service Nova Scotia for final determination.

    6. Program Changes and Cancellations

    By the College: We reserve the right to modify program content, schedules, or instructors as necessary. If we cancel a program before it begins, students will receive a full refund of all tuition and fees paid.

    By the Student: Students who wish to withdraw must provide written notice to admissions@islandcareer.ca. The withdrawal date is the date written notice is received. Refunds will be calculated according to our refund policy.

    7. Attendance and Academic Requirements

    Students must maintain satisfactory attendance and academic progress as outlined in their program requirements. Excessive absences or failure to meet academic standards may result in dismissal from the program without refund.

    Attendance Policy: Students are expected to attend all scheduled classes and practical sessions. Each program has specific attendance requirements detailed in the student handbook.

    Practical/Clinical Requirements: Programs requiring practicum or clinical hours must be completed to receive certification. Students are responsible for meeting all placement requirements including immunizations, background checks, and professional conduct.

    8. Code of Conduct

    All students must adhere to our Code of Conduct, which includes:

    • Treating staff, instructors, and fellow students with respect
    • Maintaining professional behavior in all settings
    • Following safety protocols and procedures
    • Respecting college property and equipment
    • Maintaining academic integrity (no plagiarism or cheating)
    • Complying with workplace policies during practicum placements
    • Not engaging in harassment, discrimination, or violence

    Violations of the Code of Conduct may result in disciplinary action including dismissal from the program without refund.

    9. Massage Therapy Clinic Services

    Our student massage therapy clinic provides services to the public as part of our educational program:

    • Services: Massage therapy services are provided by supervised students in training, not licensed massage therapists
    • Booking and Payment: Appointments must be booked online and paid in advance. Cancellations made less than 24 hours before the appointment are not eligible for refund
    • Health Information: Clients must disclose relevant health conditions that may affect treatment. Services may be refused if conditions present risk
    • Consent: All clients must provide informed consent before receiving services
    • Liability: While we maintain appropriate supervision and safety protocols, clients acknowledge services are provided by students in training

    10. Intellectual Property

    All content on our website, including text, graphics, logos, images, and software, is the property of Island Career Academy or its licensors and protected by Canadian copyright law. You may not reproduce, distribute, modify, or create derivative works without our written permission.

    Course Materials: Educational materials provided during programs are for personal educational use only and may not be shared, reproduced, or distributed.

    11. Disclaimers and Limitations of Liability

    Educational Outcomes: While we strive to provide quality education and support, we do not guarantee employment, licensure, or certification upon program completion. Success depends on individual effort, market conditions, and meeting all requirements of licensing bodies.

    Program Approval Notice: The Practical Nursing (LPN) program is pending approval by the Nova Scotia Department of Advanced Education. Enrollment is subject to program approval. If approval is not granted, students will receive a full refund of all tuition and fees paid.

    Website Accuracy: While we strive to provide accurate information, content on our website may contain errors or become outdated. We reserve the right to correct errors and update information without notice.

    Limitation of Liability: To the maximum extent permitted by law, Island Career Academy shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services or website.

    12. Complaints and Dispute Resolution

    We are committed to resolving complaints fairly and promptly:

    • Internal Process: Complaints should first be directed to admissions@islandcareer.ca or (902) 564-6112. We will investigate and respond within 14 business days
    • Escalation: If not satisfied with our response, you may file a complaint with Service Nova Scotia – Private Career Colleges Division within 12 months of the incident

    13. Governing Law

    These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Nova Scotia.

    14. Accessibility

    Island Career Academy is committed to providing accessible education and services. Students requiring accommodations should contact us to discuss their needs. We will work to provide reasonable accommodations in accordance with applicable human rights legislation.

    15. Privacy

    Your use of our services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with PIPEDA and the Private Career Colleges Act.

    16. Severability

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

    17. Changes to Terms

    We may update these Terms from time to time. Significant changes will be communicated to enrolled students. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
